Personally Identifiable Information
PII is information that allows CD or its 3rd Party Partners to identify and communicate with an individual consumer. Information may be acquired via a 3rd Party Partner’s Web site or through our lead brokerage and marketing partner relationships with 3rd Party Partners. CD, consistent with such 3rd Party Partner’s privacy policies, may collect or maintain the following PII about consumers that it obtains from such 3rd Party Partners:
- First and Last Name
- Physical Address
- Email Address
- Phone Number
- Fax Number
- Any other PII the user submits during the course of normal correspondence with CD or its third-party partners

Non-personally identifiable information is information acquired by CD in the normal course of operating its business that does not reveal the specific identity of the consumer. Types of non-personally identifiable information we may collect include, but are not limited to:

- Consumer registration preferences
- Aggregate click-stream data provided to CD by 3rd Party-Partners or third-party companies involved in data enhancement and tracking services
How We Use and Share Consumer Information

Consumer PII Managed by CD
CD receives PII from 3rd Party Partners and provides that PII to one or more of its 3rd Party Partners. CD may also use that PII to send relevant marketing content from 3rd Party Partners and other marketing messages to those recipients. CDs use’s its best efforts to make certain that PII collected by 3rd Party Partners is limited to the uses allowed under such 3rd Party Partners’ privacy policy and such 3rd Party Partners represent to us that they act consistently with their privacy policies and that those policies permit their sharing of your PII with us and other 3rd Party Partners. CD may also use data enhancement providers to supplement the consumer PII we hold. Data enhancement providers are prohibited by contract from sharing the combined PII with any party other than CD. The combined PII enables CD to offer you better tailored and more relevant advertising.

Sharing of Consumer PII with Third Parties
If the 3rd Party Partner has obtained permission from you to do so, we may sell, rent or lease such PII.
We may use your PII and/or transfer the personal information you supply via our service through 3rd Party Partners to other 3rd Party Partners, subject to applicable state and federal law, for any legal purpose including, without limitation to: (a) bring selected retail opportunities and promotional offers to you via direct mail marketing, e-mail marketing, telemarketing and/or online banner advertising; (b) when necessary, to receive a product or service that you may have ordered or inquired about from such 3rd Party Partner while using our service or when responding to offers through other 3rd Party Partners; (c) SMS text-based marketers (where permitted by applicable law); and (e) for validation, suppression, content improvement and feedback purposes. CD may also share PII with service providers who assist us with our marketing efforts on behalf of our customers. These businesses may include, but are not limited to: providers of direct marketing services and applications, including lookup and reference, and data enhancement, suppression and validation services. These services enable us to deliver marketing communications to you, verify and update information about you and offer you better tailored and more relevant advertising.
CD may also share PII in the following limited circumstances: (1) upon receipt of a properly authorized and authenticated governmental request for information; (2) in response to a subpoena or a court order; (3) to comply with relevant laws; (4) in response to an investigation of fraud regarding a specific consumer; (5) in an effort to safeguard the person or property of a CD employee or a third party; or (6) when CD believes it is necessary to protect our interests or we believe in good faith that the law requires the sharing of your personal information.
Finally, CD may, in the future, decide to sell, merge or otherwise reorganize its business. CD reserves the right to transfer and disclose PII in this circumstance.

How we use Cookies

Opting Out of our Services

Telemarketing/SMS Services
In addition, you agree that by submitting your registering for the products and/or service offered on the Internet properties of a 3rd Party Partner constitutes an inquiry for purposes of the Amended Telemarketing Sales Rule, 16 CFR §310 et seq. (the "ATSR") and any applicable state and local do-not-call regulations. Notwithstanding that your telephone number may be listed on the Federal Trade Commission's Do-Not-Call List, or an applicable state do-not-call list, CD retains the right to contact you via telemarketing in accordance with the ATSR and the applicable state regulations. Moreover, by registering with, or requesting information from, a 3rd Party Partner acting as an advertiser at or through a 3rd Party Partner’s Site, such action shall constitute a purchase, an inquiry and/or an application with the respective 3rd Party Partner for purposes of the ATSR and any applicable state and local do-not-call regulations and you may be contacted via e-mail, direct mail and/or telemarketing by such 3rd Party Partner in accordance with the ATSR and the applicable state regulations.
In addition, you agree that by submitting your mobile telephone number for an offer or on our site, you agree to receive mobile marketing including, but not limited to, text-message based marketing, from us and our 3rd Party Partners and marketers (where, and to the extent that, such marketing is permitted by applicable law). As such, notwithstanding that your mobile telephone number may be listed on state and/or federal Do-Not-Call registries, we retain the right to contact you via text-message based marketing in accordance with applicable state and federal law. CD, and our 3rd Party Partners, may maintain separate marketing databases for different purposes. Third-Party Offers
CD provides its' users with the opportunity to receive special offers, products and/or services from us and third parties. By providing your information to us during any of the CD information collection processes or those of our 3rd Party Partners, you are providing affirmative consent to receive offers that we feel may be of interest to you from third parties. Furthermore, if you indicate the desire to receive certain types of offers, products or services from our 3rd Party Partner(s) during the applicable information collection process on another 3rd Party Partner’s Web site, your personally identifiable information will be shared with the applicable 3rd Party Partner(s) so that such 3rd Party Partner(s) may provide their product or service to you and so that you do not have to complete another information collection form to purchase, receive or request information on that product or service.
Security
We endeavor to safeguard and protect our users' information. When dealing with PII we maintain and PII our third-party marketing partners transfer to us, such information is protected both online and offline. Currently, CD uses Secure Socket Layer Software ("SSL") to protect data and to secure any transactions. SSL encrypts information, including credit card numbers, names and addresses as they are transmitted over the Internet. Please be advised that, although we take reasonable technological precautions to protect your data, no data transmission over the Internet can be guaranteed to be 100% secure. Therefore, CD cannot warrant that your information will be absolutely secure.
Please note that any attempt to breach the security of the network, our servers, databases or other hardware or software supporting this Site or other websites under the control of CD constitutes a crime punishable by law. We will turn over to authorities, any and all evidence relating to a potential breach of security or other abuse against the network, servers, databases or other such supporting equipment or software. In compliance with applicable federal and state laws, we shall notify you in the event that we learn of an information security breach with respect to your personal information. You will be notified via e-mail in the event of such a breach. Children's Privacy
We take special steps to safeguard the privacy of children. Your California Privacy Rights
California Civil Code Section 1798.83 permits California residents who have provided PII to CD or its partners to request certain information regarding CD’s disclosure of PII to third parties for their direct marketing purposes. Within thirty days of receiving such a request, we will provide a list of the categories of PII disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. We reserve our right not to respond to requests submitted other than to the address specified in this section.
